NATIONAL & FEDERAL

All power derives from the consent of the governed. That consent is contingent and granted only upon good behavior of the grantees. We the People are the answer to the question of what happens if a President violates the law of a Court Order. The people must consent or not give consent as the governed.

DEPORTATION

PETTIONS:

ACTIONS: Trump has crossed a line by intentionally violated a court order and admitted to doing so. This president has thereby declared that the rule of law has ended.

American Due Process is not being observed. The administration sent hundreds of alleged criminals but not convicted criminals against a court order.

You do not need a permit to gather in response to something outrageous that has happened within 48 hours.

Deportation & the Constitution

While the US Constitution doesn't explicitly mention "deportation," it grants Congress the power to establish a "uniform Rule of Naturalization" and to regulate immigration, which includes the power to remove non-citizens. Individuals facing deportation are entitled to due process rights, including the right to a hearing and to present evidence. [1, 2, 3, 4]

Here's a more detailed explanation: [2]

  • Constitutional Basis for Immigration Regulation: [2]

  • Article I, Section 8, Clause 4: This clause grants Congress the power to "establish a uniform Rule of Naturalization". [2, 5]

  • Immigration and Nationality Act (INA): Congress has used this power to enact the INA, which outlines the legal framework for immigration, including deportation. [6, 7]

  • Presidential Authority: The President also has certain powers related to immigration, including the ability to suspend the entry of certain aliens. [8]

  • Due Process Rights for Deportation: [3] https://constitution.congress.gov/browse/essay/artI-S8-C18-8-7-2/ALDE_00001262/

  • Fifth Amendment: The Fifth Amendment protects against being deprived of "life, liberty, or property, without due process of law". [3, 9]

  • Due Process in Deportation: Individuals facing deportation are entitled to due process, which includes the right to a hearing, to present evidence, and to appeal adverse decisions. [1, 3, 6]

  • Right to Counsel: While not explicitly mentioned in the Constitution, the Sixth Amendment's right to counsel in criminal prosecutions has been extended to deportation proceedings. [1]

  • Examples of Deportation-Related Laws: [10]

  • Alien Enemies Act: This law, enacted in 1798, allows the President to detain or deport aliens who are citizens of a country with which the US is at war. [10]

  • Deportable Aliens (8 U.S.C. 1227): This section of the INA outlines the grounds for which an alien may be deported. [11]

  • Key Considerations: [12] https://www.youtube.com/watch?v=5oTxBkdAFnA

  • Citizenship vs. Deportation: The Constitution protects the rights of US citizens, and it is generally understood that the government cannot involuntarily strip a citizen of their citizenship. [12]

  • Mass Deportation: While the Constitution does not explicitly address mass deportation, any such effort would likely face legal challenges based on due process protections. [13]
